شوہر کے حقوق
حضرت ابو ہریرہ رضی اللہ تعالیٰ عنہ سے روایت ہے کہ رسول اللہ صلی اللہ علیہ وسلم نے ارشاد فرمایا کہ: ''اگر کوئی مرد اپنی عورت کو ہم بستر ہونے کے لیے بلائے اور وہ عورت انکار کر دے اور پھر شوہر (اس کے انکار کی وجہ سے) رات بھر غصے کی حالت میں رہے تو فرشتے اس عورت پر صبح تک لعنت بھیجتے رہتے ہیں۔'' (بخاری و مسلم)
ہر مسلمان اس بات کو جانتا ہے کہ خاوند کے بیوی پر اور بیوی کے خاوند پر کچھ حقوق ہیں، جیسا کہ ارشادِ باری تعالیٰ ہے۔
﴿اور عورتوں کا حق (مردوں پر) ویسا ہی ہے جیسے دستور کے مطابق (مردوں کا حق) عورتوں پر ہے، البتہ مردوں کو عورتوں پر فضیلت ہے﴾ (البقرہ ۲۲۸)
اس آیت کریمہ نے خاوند، بیوی دونوں کے ایک دوسرے پر کچھ حقوق و آداب ثابت کیے ہیں، یعنی دونوں ایک دوسرے سے ملتے جلتے حقوق ہیں، جن کے پورے کرنے کے دونوں شرعاً پابند ہیں، جبکہ خصوصی اختیارات کی بنیاد پر مردوں کو عورتوں پر فضیلت یا ایک درجہ کی خصوصیت حاصل ہے، مثلاً فطری قوتوں میں، جہاد کی اجازت میں، میراث کے دوگنا ہونے میں، قوامیت اور حاکمیت میں اور اختیارِ طلاق و رجوع وغیرہ میں۔
خاوند بیوی کے تعلق میں یہ ضروری تھا کہ کسی ایک کو سربراہی کا درجہ دیا جائے اور اسی حساب سے اس پر ذمہ داریاں بھی ڈالی جائیں اور ظاہر ہے کہ اپنی فطری برتری کے لحاظ سے اس کے لیے خاوند ہی زیادہ موزوں ہو سکتا تھا، چنانچہ شریعتِ محمدی صلی اللہ علیہ وسلم میں گھر میں مرد ہی کو سربراہ و مربی قرار دیا گیا ہے اور بڑی ذمہ داریاں اسی پر ڈالی گئی ہیں، فرمانِ باری تعالیٰ ہے۔
﴿مرد عورتوں کے سربراہ اور ذمہ دار ہیں﴾ (النساء ۳۴)
اور عورتوں کو حکم دیا گیا ہے کہ وہ گھر کے سربراہ و ذمہ دار اور اپنے سرتاج کی حیثیت سے خاوند کی بات مانیں اور بیوی ہونے کی حیثیت سے ان کی جو مخصوص ذمہ داریاں ہیں ان کی ادائیگی میں کوتاہی نہ کریں چنانچہ ان کے لیے فرمایا گیا ہے۔
﴿نیک بیویاں (خاوندوں) کی فرمانبردار ہوتی ہیں اور خاوند کے پیچھے بھی (اس کی آبرو اور ہر امانت کی) حفاظت کرتی ہیں﴾ (النساء ۳۴)
اگر عورت خاوند کی اطاعت و فرمانبرداری کے بجائے نافرمانی و سرکشی کا رویہ اختیار کرے تو ظاہر ہے کہ اس کے نتیجے میں پہلے تلخ کشمکش اور پھر خانہ جنگی ہوگی جو دونوں کی دینی اور دنیاوی بربادی کا باعث ہوگی، اس لیے رسول اللہ صلی اللہ علیہ وسلم نے عورتوں کو خاوندوں کی اطاعت و فرمانبرداری اور رضا جوئی کی تاکید میں وعیدیں بھی فرمائی ہیں اور اس کا عظیم اجر و ثواب بیان فرما کر ترغیب بھی دی ہے۔
ایک روایت میں شوہر کی فرمانبرداری کی ترغیب اس انداز میں دی گئی ہے کہ عورت جب پانچوں وقت کی نماز پڑھے اور ماہِ رمضان کے روزے رکھے اور اپنی شرم و آبرو کی حفاظت کرے اور خاوند کی فرمانبردار رہے تو پھر (اسے حق ہے کہ) جنت کے جس دروازے سے چاہے اس میں داخل ہو۔ (بحوالہ ابو نعیم)
جبکہ ایک روایت میں اس وعید کے ذریعے خاوند کی نافرمانی کے نتیجے کی تلقین کی گئی ہے کہ دو قسم کے لوگ ہیں جن کی نمازیں ان کے سروں سے اوپر نہیں اٹھتیں، اس غلام کی نماز جو اپنے آقا سے فرار ہو جائے جب تک وہ لوٹ نہ آئے اور اس عورت کی نماز جو خاوند کی نافرمانی کرے جب تک کہ خاوند کی نافرمانی سے باز نہ آ جائے۔ (بحوالۃ الحدیث)
خاوند کی فرمانبرداری عورت کے لیے کس درجہ میں شامل ہے اس کا اندازہ رسول اللہ صلی اللہ علیہ وسلم کے اس فرمان سے بخوبی ہوتا ہے کہ کسی انسان کے لیے یہ جائز نہیں کہ وہ کسی دوسرے انسان کو سجدہ کرے، اگر اس کی اجازت ہوتی تو بیوی کو حکم دیا جاتا کہ وہ اپنے خاوند کو سجدہ کرے۔
خاوند کی فطری خواہشات کو پورا کرنے کے لیے عورت کو کس حد تک تلقین کی گئی ہے اس کا اندازہ اس حدیث سے ہوتا ہے کہ جب کوئی شخص اپنی بیوی کو اپنی (فطری) حاجت پوری کرنے کے لیے (یعنی جماع کے لیے) بلائے تو بیوی کو خاوند کے پاس پہنچنا چاہیے اگرچہ وہ چولہے کے پاس ہو۔ (بحوالہ ترمذی)
خاوند کی وعید اس صورت میں ہے جبکہ بیوی کوئی شرعی عذر نہ ہونے کے باوجود خاوند کے بستر پر آنے سے انکار کرے، اس حدیث سے یہ معلوم ہوا کہ خاوند کی ناراضگی اللہ تعالیٰ کی ناراضگی کا باعث ہے اور جب فطری جذبات کی تسکین کے بارے میں خاوند کی ناراضگی کی یہ اہمیت ہے تو غور کریں کہ کسی دینی معاملہ میں خاوند کی ناراضگی کی کتنی اہمیت ہوگی۔ لہٰذا اپنے خاوند سے محبت کیجیے اور اس کی رفاقت کی قدر کیجیے، یہ زندگی کی زینت، زندگی کا سہارا اور راہِ حیات کا عظیم معین و مددگار ہے، اللہ تعالیٰ کی اس عظیم نعمت پر اللہ تعالیٰ کا بھی شکر ادا کیجیے اور اس نعمت کی بھی دل و جان سے قدر کیجیے۔
﴿اور عورتوں کا حق (مردوں پر) ویسا ہی ہے جیسے دستور کے مطابق (مردوں کا حق) عورتوں پر ہے، البتہ مردوں کو عورتوں پر فضیلت ہے﴾ (البقرہ ۲۲۸)
اس آیت کریمہ نے خاوند، بیوی دونوں کے ایک دوسرے پر کچھ حقوق و آداب ثابت کیے ہیں، یعنی دونوں ایک دوسرے سے ملتے جلتے حقوق ہیں، جن کے پورے کرنے کے دونوں شرعاً پابند ہیں، جبکہ خصوصی اختیارات کی بنیاد پر مردوں کو عورتوں پر فضیلت یا ایک درجہ کی خصوصیت حاصل ہے، مثلاً فطری قوتوں میں، جہاد کی اجازت میں، میراث کے دوگنا ہونے میں، قوامیت اور حاکمیت میں اور اختیارِ طلاق و رجوع وغیرہ میں۔

English translation
It is narrated from Abū Hurayrah (may Allah be pleased with him) that the Messenger of Allah ﷺ said: "If a man calls his wife to bed and she refuses, and the husband then spends the night angry (on account of her refusal), the angels curse that woman until morning." (Bukhari and Muslim)
Every Muslim knows that the husband has certain rights over the wife and the wife has certain rights over the husband, as Allah Almighty says: "And women have rights (over men) similar to those (of men) over them according to what is reasonable, but men have a degree over them." (Al-Baqarah 228)
This noble verse establishes certain mutual rights and etiquettes between husband and wife — that is, both have rights over one another that resemble each other, which both are bound by the Sharia to fulfil — while, on the basis of special prerogatives, men have been given a certain excellence or a degree of distinction over women; for example, in natural strength, in permission for jihad, in the double share of inheritance, in guardianship and authority, and in the right of divorce and revocation, and so on.
In the relationship of husband and wife it was necessary that one of the two be given the position of head, and that responsibilities be placed upon that one accordingly; and it is clear that, by his natural superiority in these respects, the husband was better suited for this. Thus in the Sharia of Muhammad ﷺ the man has been made the head and guardian of the household, and the greater responsibilities have been placed upon him. Allah Almighty says: "Men are the guardians and maintainers of women." (An-Nisā 34)
And women have been commanded to obey the husband as the head and responsible one of the house and as their protector, and, in their capacity as wives, not to fall short in fulfilling the special responsibilities that are theirs. Thus it has been said concerning them: "Righteous women are obedient (to their husbands) and guard in the husband's absence what (his honour and every trust) Allah would have them guard." (An-Nisā 34)
If a woman, instead of obeying and being loyal to her husband, adopts an attitude of disobedience and defiance, it is clear that the result will be first bitter conflict and then strife within the home, which will bring about the religious and worldly ruin of both. That is why the Messenger of Allah ﷺ, in emphasising to women obedience, loyalty, and the seeking of their husbands' pleasure, has both issued warnings and, by mentioning its great reward, given encouragement.
In one narration, encouragement to obey the husband is given in this manner: when a woman prays the five daily prayers, keeps the fasts of the month of Ramadan, guards her chastity and honour, and remains obedient to her husband, then (she has the right) to enter Paradise by whichever of its gates she wishes. (From Abū Nuʿaym)
While in another narration, through a warning, the consequence of disobeying the husband is impressed: there are two kinds of people whose prayers do not rise above their heads — the slave who flees from his master, until he returns; and the woman who disobeys her husband, until she desists from disobeying him. (As reported in the hadith)
How great a place obedience to the husband holds for a woman can be well judged from this saying of the Messenger of Allah ﷺ: that it is not permissible for any human to prostrate to another human, but had it been permissible, the wife would have been commanded to prostrate to her husband.
To what extent a woman has been urged to fulfil her husband's natural desires can be judged from this hadith: when a man calls his wife to fulfil his natural need (that is, for intimacy), the wife should come to her husband even if she is at the hearth. (From Tirmidhī)
The warning regarding the husband applies where the wife, despite having no lawful excuse, refuses to come to her husband's bed. From this hadith it is learnt that the husband's displeasure is a cause of Allah's displeasure; and when the husband's displeasure carries such importance in the matter of satisfying natural desires, then consider how much importance it must carry in a religious matter. So love your husband and value his companionship; he is the adornment of life, the support of life, and a great helper and aid on the path of life. Give thanks to Allah Almighty for this great blessing, and value this blessing with all your heart and soul.
