حد کا بیان
حضرت عبادہ بن صامت رضی اللہ تعالیٰ عنہ کا بیان ہے کہ رسول اللہ صلی اللہ علیہ وسلم نے ارشاد فرمایا: ”حدود قائم کرو چاہے قریبی رشتے دار ہوں یا دور کے، اور حدود قائم کرنے میں کسی کی ملامت اور رعب کا خیال نہ کرو۔“ (ابن ماجہ)
کسی بھی معاشرے کی بقا اور سلامتی کے لیے ضروری ہے کہ اس کے نیک اور صالح لوگوں کو برے اور مجرم لوگوں سے بچایا جائے، اسی کی خاطر نظام قانون بنایا جانا ہے اور عدالتیں قائم کی جاتی ہیں۔ اسلامی نظام حیات میں بھی اس پہلو سے بھرپور تعلیمات موجود ہیں چنانچہ قرآن پاک میں مختلف مقامات پر اس سلسلے میں آیات موجود ہیں۔ مثلاً سورۃ بقرہ ۱۷۸، ۱۷۹ میں قتل کی سزا کا ذکر ہے۔ سورۃ مائدہ ۳۳، ۳۴ میں فتنہ فساد بر پا کرنے والوں کی سزا کا ذکر ہے۔ سورۃ مائدہ ۳۸، ۳۹ میں چوری کی سزا کا ذکر ہے۔ سورۃ نور ۲ میں زنا کی سزا کا ذکر ہے، تہمت کی سزا کا ذکر سورۃ نور ۴، ۵ میں ہے۔
برخلاف دوسرے نظام قانون کے جن میں جرائم کی تمام سزاؤں کو تعزیرات کہا جاتا ہے خواہ وہ کسی جرم سے متعلق ہوں، شریعت اسلام میں جرائم کی سزاؤں کی تین قسمیں قرار دی گئی ہیں جو (۱) حدود (۲) قصاص (۳) تعزیرات ہیں۔
ان میں سے تعزیرات میں قرآن و سنت نے کوئی سزا مقرر نہیں کی ہے بلکہ حکومت یا پارلیمان کے اختیار میں دیا ہے کہ زمانے اور ماحول کے لحاظ سے جیسی اور جتنی سزا انسدادِ جرم کے لیے ضروری ہو جاری کرے۔ حد جس کی جمع حدود ہے اور قصاص میں شریعت نے سزا کو مقرر فرما دیا ہے۔ تعزیری سزائیں حالات کے تحت ہلکی سے اور سخت سے سخت بھی دی جا سکتی ہیں اور معاف بھی کی جا سکتی ہیں ان میں حکومت وقت کو بہت اختیارات حاصل ہیں۔ حدود میں کسی حکومت یا پارلیمان کو ذرا سے بھی تبدیلی کی اجازت نہیں ہے اور نہ زمان و مکان کی تبدیلی سے ان پر کوئی اثر پڑتا ہے اور نہ ہی ان کو معاف کیا جا سکتا ہے۔ شریعت اسلام میں حدود پانچ ہیں: (۱) ڈاکہ (۲) چوری (۳) زنا (۴) تہمت زنا جن کا قرآن میں ذکر ہے۔ پانچویں حد شراب پینے پر ہے جو اجماع صحابہ رضی اللہ عنہم سے ثابت ہے۔ یہ سزائیں جس طرح کوئی حاکم معاف نہیں کر سکتا اسی طرح توبہ کر لینے سے بھی دنیاوی سزا معاف نہیں ہوتی۔ آخرت کا گناہ سچی توبہ سے معاف ہو سکتا ہے۔ البتہ ڈاکے کی سزا میں اگر ڈاکو گرفتاری سے قبل توبہ کر لے اور معاملات سے اس کی توبہ پر اطمینان ہو جائے تو اس کی حد ساقط ہو جائے گی، گرفتاری کے بعد کی توبہ کا اعتبار نہیں۔ حدود میں سفارش کرنا بھی جائز نہیں اور ان کا سننا بھی جائز نہیں۔
جہاں اسلام حدود میں سختی رکھی گئی ہے وہیں اس کو ثابت کرنے کی شرائط بھی بہت سخت رکھی گئی ہیں جن میں سے ایک شرط بھی پوری نہ ہو تو حد ساقط ہو جاتی ہے بلکہ ذرا سے شبہ بھی ثبوت میں پایا جائے تو حد ساقط ہو جاتی ہے۔ البتہ اگر دوسرے ثبوتوں سے یہ معلوم ہو جائے کہ جرم کا ارتکاب کیا گیا ہے تو اس صورت میں حد تو نافذ نہ ہوگی البتہ تعزیر جاری کی جائے گی، جس میں جج یا قاضی کو اختیار ہے کہ ملکی قوانین کے مطابق جو سزا چاہے دے۔
قصاص کی سزا بھی حدود کی طرح قرآن میں آئی ہے کہ جان کے بدلے جان لی جائے، زخم کے بدلے برابر کے زخم کی سزا دی جائے گی۔ البتہ حدود اور قصاص میں فرق یہ ہے کہ حدود کے معاملے میں اگر صاحب حق معاف بھی کرنا چاہے تو معاف نہ ہوگا اور حد جاری کی جائے گی۔ مثلاً جس کا مال چوری کیا ہے وہ معاف بھی کر دے تو چوری کی شرعی سزا معاف نہیں ہوگی، جب کہ قصاص میں صاحب حق کو اختیار ہے چاہے معاف کر دے چاہے بدلہ لے۔ مثلاً قتل کی صورت میں جرم ثابت ہونے پر مقتول کے ورثا کو اختیار ہے چاہے قصاص لیں اور قتل کرا دیں اور چاہے معاف کر دیں۔ یہاں بھی یہ واضح ہوا ضروری ہے کہ ورثا کے معاف کر دینے سے قصاص تو معاف ہو جائے گا لیکن حکومت وقت کو اختیار ہے کہ اس جرم پر تعزیری سزا جتنی اور جیسی مناسب سمجھے دے تا کہ عادی مجرموں کو عبرت ہو اور معاشرے کے امن پسند لوگوں کو اطمینان حاصل ہو۔
یہ ہے شریعت اسلام کی لچک اور وسعت کہ یہ دین ہر زمانے میں قابل عمل اور ہر مقام پر نافذ ہونے کی صلاحیت رکھتا ہے۔ چنانچہ یہ چند سزائیں جب اور جہاں نافذ کر دی جائیں گی تو معاشرے کا امن و عافیت سے بھر جائے گا اور یقیناً اس کا مشاہدہ ہم اور آپ کر چکے ہیں۔ اس کے مقابلے میں خود ساختہ قوانین کی بھر مار کے باوجود ترقی یافتہ ممالک جرم کی بڑھتی ہوئی رفتار کے سامنے عاجز ہو چکے ہیں۔ یہاں تک کہ جیلیں بھر چکی ہیں لیکن جرم سیلاب کی طرح بڑھتا جا رہا ہے اور اب حکومتیں بھی اس کے سامنے بے بس نظر آتی ہیں اور وہ اس کو ایک لا علاج مرض کے طور پر قبول کرتی نظر آتی ہیں۔

English translation
Ubadah ibn as-Samit (may Allah be pleased with him) reported that the Messenger of Allah (peace and blessings be upon him) said: "Establish the prescribed punishments (hudud), whether they be near relatives or distant, and in establishing the hudud pay no regard to anyone's reproach or intimidation."
For the survival and security of any society it is necessary that its good and righteous people be protected from evil and criminal people. It is for this purpose that a system of law is made and courts are established. In the Islamic way of life too there are abundant teachings on this aspect; thus in the Holy Qur'an there are verses on this subject in various places. For example, Surah al-Baqarah 178, 179 mentions the punishment for murder; Surah al-Ma'idah 33, 34 mentions the punishment for those who spread corruption and disorder; Surah al-Ma'idah 38, 39 mentions the punishment for theft; Surah an-Nur 2 mentions the punishment for adultery; and the punishment for false accusation is mentioned in Surah an-Nur 4, 5.
Unlike other legal systems, in which all punishments for crimes are called ta'zirat (discretionary), whatever crime they relate to, in the Shariah of Islam the punishments for crimes have been fixed into three categories: (1) hudud, (2) qisas, and (3) ta'zirat.
Of these, in ta'zirat the Qur'an and Sunnah have not fixed any punishment; rather it has been left to the discretion of the government or parliament to impose whatever kind and degree of punishment is necessary, in view of the time and environment, to suppress crime. In hadd (whose plural is hudud) and in qisas, the Shariah has fixed the punishment. Ta'ziri punishments can, according to circumstances, be light or as severe as possible, and can also be pardoned; in these the government of the time has extensive powers. In the hudud, no government or parliament is permitted even the slightest change, nor does any change of time or place have any effect on them, nor can they be pardoned. In the Shariah of Islam the hudud are five: (1) armed robbery, (2) theft, (3) adultery, (4) false accusation of adultery — which are mentioned in the Qur'an. The fifth hadd is for drinking wine, which is established by the consensus (ijma) of the Companions (may Allah be pleased with them). Just as no ruler can pardon these punishments, likewise the worldly punishment is not waived by repentance. A sin of the Hereafter can be pardoned through sincere repentance. However, in the case of the punishment for armed robbery, if the robber repents before arrest and there is satisfaction as to his repentance from the circumstances, then his hadd will lapse; repentance after arrest is not accepted. In the hudud, making intercession is also not permissible, nor is listening to it permissible.
While Islam has kept the hudud strict, it has also kept the conditions for proving them very strict; if even one of these conditions is not fulfilled, the hadd lapses; indeed, if even the slightest doubt is found in the evidence, the hadd lapses. However, if it becomes known from other evidence that the crime was committed, then in that case the hadd will not be enforced, but ta'zir will be applied, in which the judge or qadi has the discretion to impose whatever punishment he wishes in accordance with the laws of the land.
The punishment of qisas too, like the hudud, has come in the Qur'an: that life be taken for life, and for a wound an equal wound be given as punishment. However, the difference between hudud and qisas is that in the matter of hudud, even if the one entitled to the right wishes to pardon, it will not be pardoned and the hadd will be applied. For example, if the one whose property was stolen pardons, the Shariah punishment for theft will not be waived; whereas in qisas the one entitled to the right has the choice — whether to pardon or to take retaliation. For example, in the case of murder, once the crime is proven, the heirs of the slain have the choice: whether to take qisas and have the killer executed, or to pardon. Here too it becomes clear that when the heirs pardon, the qisas is indeed waived, but the government of the time has the discretion to impose on that crime whatever ta'ziri punishment it deems appropriate in kind and degree, so that habitual criminals may take heed and the peace-loving people of society may attain reassurance.
This is the flexibility and breadth of the Shariah of Islam — that this religion is capable of being put into practice in every age and enforced in every place. Thus, when and where these few punishments are enforced, society will be filled with peace and well-being, and indeed we and you have witnessed this. In contrast, despite an abundance of man-made laws, the developed nations have become helpless before the rising pace of crime — so much so that the prisons have filled up, yet crime keeps rising like a flood, and now even governments appear powerless before it and appear to accept it as an incurable disease.
