حقوق کی ادائیگی

عَنْ أَبِىْ هُرَيْرَةَ أَنَّ رَسُوْلَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ قَالَ لَتُؤَدُّنَّ الْحُقُوْقَ إِلٰى أَهْلِهَا يَوْمَ الْقِيَامَةِ حَتّٰى يُقَادَ لِلشَّاةِ الْجَلْحَاءِ مِنَ الشَّاةِ الْقَرْنَاءِ ـ
حضرت ابوہریرہ رضی اللہ عنہ سے روایت ہے کہ رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: ”ضرور بالضرور تم حقداروں کے حق ادا کرو گے قیامت کے دن (ایسا ہوگا!) یہاں تک کہ بغیر سینگ والی بکری کا بدلہ سینگ والی بکری سے لیا جائے گا۔“ (صحیح مسلم)
دین اسلام دلوں کو جوڑنے اور محبت و یگانگت پیدا کرنے والا دین ہے۔ وہ انسانی معاشرہ کو ایک جسد واحد کی طرح دیکھنا چاہتا ہے اسی لیے اس میں عدل و انصاف اور حقداروں کا ان کا حق ادا کرنے پر بہت زور دیا گیا ہے۔ اس لیے کہ عدل و انصاف سے روگردانی اور حقوق کی ادائیگی میں کوتاہی فساد اور تباہی کا سب سے بڑا ذریعہ ہے۔

نبی کریم صلی اللہ علیہ وسلم کی سیرت کے سلسلے میں ایک واقعہ یہ ملتا ہے کہ آپ صلی اللہ علیہ وسلم نے نبوت سے پہلے ایک ایسے معاہدہ میں شرکت فرمائی تھی جس کا مقصد مظلوموں کی دادرسی اور حقداروں کو ان کا حق دلوانا تھا۔ اس معاہدہ کا نام حلف الفضول تھا۔ اور آپ صلی اللہ علیہ وسلم نے فرمایا کہ اب اگر زمانہ اسلام میں بھی کوئی اس حلف کی دہائی دے کر مجھے بلائے تو میں اس کی مدد کو دوڑوں گا۔ نبی کریم صلی اللہ علیہ وسلم کا یہ ارشاد اس بات کی اہمیت کو اجاگر کرتا ہے کہ معاشرہ میں حق و انصاف کا قیام اور اس کا بقا کس قدر ضروری ہے۔

ایک واقعہ سے جو دور نبوت سے ہے اس سے معلوم ہوتا ہے کہ حقدار کو اس کے حق کی ادائیگی کو آپ صلی اللہ علیہ وسلم کس قدر اہمیت دیتے تھے۔ ایک شخص نے جو مکہ مکرمہ میں سے نہیں تھا بلکہ کسی اور جگہ سے آیا تھا اپنا اونٹ ابو جہل کو فروخت کیا۔ لیکن وہ اس کی قیمت ادا کرنے میں پس و پیش کرنے لگا۔ اس شخص نے اپنا معاملہ قریش کے سرداروں کے جو اس وقت حرم میں بیٹھے ہوئے تھے پیش کیا۔ آپ صلی اللہ علیہ وسلم بھی اس وقت وہیں تشریف فرما تھے۔ کسی طور وہ شخص آپ صلی اللہ علیہ وسلم کے پاس حاضر ہوا اور درخواست کی کہ مجھے میرا حق ابو جہل سے دلوا دیجیے۔ آپ صلی اللہ علیہ وسلم کسی توقف کے بغیر اس شخص کو لے کر اپنے جانی دشمن ابو جہل کے گھر پہنچ گئے اور اس کو حکم دیا کہ ابھی اس کا حق اسے دو اور اس دشمن دین کو اس کی تعمیل کے بغیر کوئی چارہ نہ تھا۔

قرآن پاک میں بھی کئی آیتیں آئی ہیں جن میں عدل و انصاف سے کام لینے کی تاکید آئی ہے۔ مثلاً:
﴿اور جب (کسی کی نسبت) کوئی بات کہو تو انصاف سے کہو خواہ وہ (تمہارا) رشتہ دار ہی ہو۔﴾ (انعام-۱۵۴)
﴿اور اللہ تم کو انصاف اور احسان کرنے کا حکم دیتا ہے۔﴾ (نحل-۹۰)
﴿اور جب لوگوں میں فیصلہ کرنے لگو تو انصاف سے فیصلہ کیا کرو۔﴾ (نساء-۵۸)

لیکن انسان جب اپنے خالق و مالک کو بھول جاتا ہے اور آخرت میں جواب دہی کا تصور اس کے ذہن سے اتر جاتا ہے تو پھر یہ سب باتیں اس کے نزدیک کوئی اہمیت نہیں رکھتیں۔ وہ حقدار کا حق مارنا اپنی عقلمندی سمجھتا ہے۔ لیکن اس دنیا کی یہ عقلمندی آخرت میں کسی کام نہ آئے گی۔ وہاں تو ذرے ذرے کا حساب دینا ہوگا۔ وہ دن انصاف کا دن ہوگا اور کسی کی حق تلفی نہ کی جائے گی۔
﴿اور ہم قیامت کے دن انصاف کی ترازو کھڑی کریں گے تو کسی شخص کی ذرا بھی حق تلفی نہیں کی جائے گی۔ اور اگر رائی کے برابر بھی (کسی کا عمل) ہوگا تو ہم اس کو لا موجود کریں گے اور ہم حساب کرنے کو کافی ہیں۔﴾ (انبیاء-۴۷)

اس حدیث میں آپ صلی اللہ علیہ وسلم کا یہ فرمانا کہ بغیر سینگ والی بکری کا بدلہ سینگ والی بکری سے لیا جائے گا یہ اس بات کی طرف اشارہ ہے کہ حقوق کا معاملہ بڑا سخت ہے۔ گو جانوروں کے لیے جنت دوزخ نہیں لیکن یہ معاملہ اللہ کی صفت عدل کا مظہر ہے جو اس دن کامل طور پر ظاہر ہوگی۔
English translation
Abu Hurayrah (may Allah be pleased with him) narrates that the Messenger of Allah ﷺ said: "You will most certainly render to those entitled the rights owed to them on the Day of Resurrection — so much so that the hornless sheep will be given retaliation against the horned sheep."

The religion of Islam is a religion that joins hearts together and creates love and harmony. It wishes to see human society as a single body, and for this reason it lays great stress on justice and fairness and on rendering to those entitled the rights owed to them — for turning away from justice and falling short in discharging rights is the greatest cause of corruption and ruin.

In the life of the Prophet ﷺ there is an incident in which, before prophethood, he took part in a pact whose purpose was to obtain redress for the oppressed and to secure for the rightful their due. That pact was called Hilf al-Fudul. And the Prophet ﷺ said that if even now, in the time of Islam, anyone were to call upon him in the name of that pact, he would hasten to his aid. This saying of the Prophet ﷺ highlights how necessary the establishment of truth and justice in society is, and how vital its continuance.

Another incident, from the era of prophethood, shows how much importance the Prophet ﷺ gave to a rightful person receiving his due. A man who was not from Makkah but had come from elsewhere sold his camel to Abu Jahl. But Abu Jahl began to prevaricate over paying its price. The man brought his case before the chiefs of Quraysh, who were at that time sitting in the Haram. The Prophet ﷺ was also present there at the time. Somehow the man came before the Prophet ﷺ and requested that his right be secured for him from Abu Jahl. Without the slightest delay the Prophet ﷺ took the man with him and went to the house of his own mortal enemy Abu Jahl, and ordered him to give the man his right there and then — and that enemy of the faith had no choice but to comply.

In the Noble Qur'an too there are many verses that stress acting with justice and fairness. For example: "And when you speak (concerning anyone), speak with justice, even if it concerns a relative of yours." (Al-An'am 6:154) "And Allah commands you to act with justice and kindness." (An-Nahl 16:90) "And when you judge between people, judge with justice." (An-Nisa 4:58)

But when a person forgets his Creator and Master, and the thought of being answerable in the Hereafter slips from his mind, then none of these matters carries any weight with him. He considers seizing another's right to be his own cleverness. Yet this worldly cleverness will be of no use in the Hereafter. There, an account will have to be given of every atom. That day will be the day of justice, and no one's right will be denied. "And We will set up the scales of justice on the Day of Resurrection, so no soul will be treated unjustly in the least. And if there be the weight of a mustard seed (of anyone's deed), We will bring it forth; and sufficient are We as accountant." (Al-Anbiya 21:47)

The Prophet's saying in this hadith — that the hornless sheep will be given retaliation against the horned sheep — points to the fact that the matter of rights is extremely serious. Although there is no Paradise or Hell for animals, this matter is a manifestation of Allah's attribute of justice, which will be displayed in full on that Day.
