راستے کا حق

حضرت ابوسعید خدری رضی اللہ تعالیٰ عنہ سے روایت ہے کہ نبی صلی اللہ علیہ وسلم نے ارشاد فرمایا: ”تم راستے میں بیٹھنے سے بچو!“ صحابہ نے عرض کیا، یا رسول اللہ صلی اللہ علیہ وسلم! ہمارے لیے ان مجلسوں کے بغیر چارہ نہیں، ہم وہاں بیٹھ کر باتیں کرتے ہیں، رسول اللہ صلی اللہ علیہ وسلم نے فرمایا، اگر تم کو وہاں ضرور بیٹھنا ہی ہو تو راستے کا حق دو، صحابہ رضی اللہ عنہم نے کہا، یا رسول اللہ صلی اللہ علیہ وسلم، راستے کا حق کیا ہے؟ آپ صلی اللہ علیہ وسلم نے فرمایا، نگاہوں کو پست رکھنا، تکلیف دہ چیزوں کو راستے سے ہٹا دینا، سلام کا جواب دینا، نیکی کی تلقین کرنا اور برائی سے روکنا۔ (بخاری و مسلم)
اس حدیث میں سب سے پہلے تو اس کی تلقین کی گئی ہے کہ راستے میں بیٹھنے سے بلاضرورت پرہیز کرنا چاہیے، اور اگر اس کی ضرورت ہو تو ایسی صورت میں وہاں بیٹھنے کے کچھ تقاضے ہیں، اس میں اولین حق آنکھ نیچی رکھنے یا نگاہوں کی حفاظت کرنا ہے، کیونکہ ایسی جگہ راہ گزروں سے ہر ایک کا گذر ہوتا ہے، اور اگر راستے میں کوئی گندگی پڑی ہو یا کوئی ایسی چیز ہو جس سے گزرنے والوں کو تکلیف پہنچنے کا اندیشہ ہو، مثلاً کوئی کانٹا، کوئی رکاوٹ، کوئی ایسا چھلکا جس سے پھسل کر گر جانے کا خطرہ ہو، ان کو راستے سے ہٹا دینا، گزرنے والوں کو تکلیف سے بچانے کے لیے یہ بات بھی داخل ہے کہ اپنی سواری (گاڑیوں) وغیرہ کو ایسی جگہ کھڑا کر دینا، جس سے دوسری سواریوں کا راستہ بند نہ ہو جائے۔ اس کے بعد اس کی تلقین ہے کہ سلام کا جواب دینا، کیونکہ سلام کا آغاز کرنا سنت ہے، لیکن اس کا جواب دینا واجب ہے، اگر کوئی شخص سلام کا جواب نہ دے تو گنہگار ہوگا۔ اس کے بعد ذکر ہے نیکی کے حکم کا اور برائی سے روکنے کا، یہ فریضہ تو دراصل ہر مسلمان کے فرائض میں ہے لیکن اس کا ذکر راستے کے حق کے ساتھ اس لیے فرمایا کہ راستہ ایک ایسی گذرگاہ ہے جو لوگوں کی عام آمدورفت کا ذریعہ ہے، اور اگر انسان وہاں کوئی برائی ہوتی ہوئی دیکھے تو ہر ممکن حد تک اس کو روکنے کی کوشش کرے اور اس کے ساتھ ساتھ لوگوں کو نیکی کی بھی دعوت دیتا رہے، کیونکہ اپنے اعمال کو قرآن و سنت کے تابع کر دینا جتنا ضروری ہے اتنا ہی یہ بھی اہم ہے کہ دوسروں کو بھی نیک کاموں کا حکم کرنا اور برے کاموں سے روکنا۔ اللہ تعالیٰ ہم سب کو دین کی صحیح سمجھ اور اس پر عمل کی توفیق عطا فرمائے (آمین)۔
English translation
Narrated by Abu Sa'id al-Khudri (may Allah be pleased with him): The Prophet ﷺ said, "Beware of sitting on the roadsides." The Companions said, "O Messenger of Allah ﷺ, we have no alternative to those gatherings; we sit there and talk." The Messenger of Allah ﷺ said, "If you must sit there, then give the road its due." They asked, "O Messenger of Allah, what is the due of the road?" He said, "Lowering the gaze, removing harmful things from the road, returning the greeting of salaam, enjoining good and forbidding evil."

This hadith first teaches that one should avoid sitting on the roadside without need; but if there is a need, then sitting there carries certain obligations. Foremost among them is lowering the gaze and guarding the eyes, because such a place is passed by all kinds of people. And if there is any filth lying on the road, or anything that might harm those passing by — a thorn, an obstacle, or a peel on which someone could slip and fall — it should be removed from the path. To protect passers-by from harm, this also includes parking one's vehicle in a place that does not block the way of other vehicles. After this comes the instruction to return the greeting of salaam, for initiating salaam is a Sunnah while replying to it is obligatory, and whoever does not reply to a greeting is sinful. Then there is mention of enjoining good and forbidding evil, which is in fact among the duties of every Muslim, but it is mentioned here together with the rights of the road because the road is a thoroughfare through which people commonly pass; so if a person sees a wrong being done there, he should try his utmost to stop it, and along with that keep inviting people to good. For just as it is necessary to make one's own deeds subject to the Qur'an and Sunnah, it is equally important to enjoin good and forbid evil upon others. May Allah grant us all a correct understanding of the religion and the ability to act upon it (Ameen).
