غیر اللہ کی قسم کھانا
حضرت عبداللہ بن عمر رضی اللہ تعالیٰ عنہ سے روایت ہے کہ انہوں نے حضرت عمر رضی اللہ تعالیٰ عنہ کو دیکھا کہ وہ سواری پہ بیٹھے تھے اور اپنے والد کی قسم کھا رہے تھے کہ رسول اللہ صلی اللہ علیہ وسلم نے انہیں آواز دی کہ (خبردار ہوجاؤ!) اللہ تعالیٰ تمہیں منع فرما رہا ہے کہ اپنے باپوں کی قسمیں کھاؤ، لہٰذا جسے قسم کھانا ہی ہے وہ اللہ تعالیٰ کی قسم کھائے ورنہ خاموش رہے۔ (بخاری و مسلم)
اس طرح کی قسمیں دور جاہلیت میں عام تھیں۔ آج دین سے دوری اور ناواقفیت کے سبب لوگ مختلف طرح کی قسمیں کھاتے ہیں۔ میرے باپ کی قسم، میری ماں کی قسم، تیرے سر کی قسم، تیری جان کی قسم لوگ عام طور پر استعمال کرتے ہیں۔ اس حدیث شریف میں نبی پاک ﷺ نے امت کو تعلیم دی ہے کہ اگر قسم کھانا ہے تو صرف اللہ کی قسم کھائے ورنہ خاموش رہے۔ بات یہ ہے کہ انسان جس چیز کی قسم کھاتا ہے درحقیقت اس کے دل میں اس کی عزت اور بڑائی ہوتی ہے تو ظاہر ہے کہ سب سے بڑا اور عزت والا اللہ رب العزت کے علاوہ کون ہے، تو پھر قسم بھی اسی کی کھائی جائے۔ یہاں یہ وضاحت ضروری ہے کہ جب انسان اللہ کی قسم کھاتا ہے تو ایک طرح سے اس کو اپنا گواہ اور ضامن بناتا ہے۔ لہٰذا اس کی قسم کھانے سے پہلے انسان سوچ لے کہ جس معاملے میں وہ اللہ تعالیٰ کو اپنا گواہ بنا رہا ہے وہ اس کے حق پر ہے یا باطل، ایسا نہ ہو کہ عارضی فائدے کے لیے وہ اس پر جھوٹ باندھ لے اور دنیا اور آخرت کی مصیبت مول لے۔ جھوٹی قسم کھانے والوں کے لیے قرآن مجید میں انتہائی سخت وعید آئی ہے، اللہ تعالیٰ ارشاد فرماتا ہے:
”بے شک جو لوگ اللہ تعالیٰ کے عہد اور اپنی قسموں کو تھوڑی قیمت پر بیچ ڈالتے ہیں، ان کے لیے آخرت میں کوئی حصہ نہیں، اللہ تعالیٰ نہ تو ان سے بات چیت کرے گا اور نہ ان کی طرف قیامت کے دن دیکھے گا، نہ انہیں پاک کرے گا اور ان کے لیے دردناک عذاب ہے“۔ (آل عمران ۔ ۷۷)
اور اگر انسان کوئی قسم کھالیتا ہے تو اسے پورا کرنا بھی اس پر فرض ہے:
”اور اللہ کے عہد کو پورا کرو جب کہ تم آپس میں قول و اقرار کرو اور قسموں کو ان کی پختگی کے بعد مت توڑو، حالانکہ اللہ تعالیٰ کو اپنا ضامن ٹھہرا چکے ہو، تم جو کچھ کرتے ہو اللہ اس کو بخوبی جانتا ہے“۔ (النحل ۹۱)
اللہ تعالیٰ ہم سب کو بلا ضرورت شرعی قسم کھانے سے محفوظ فرمائے، اور اگر کسی اشد ضرورت سے کوئی قسم کھائی جائے تو اس قسم کو پورا بھی کیا جائے، اور سب سے بڑھ کر جھوٹی قسم کھانے سے محفوظ رکھے (آمین)۔
”بے شک جو لوگ اللہ تعالیٰ کے عہد اور اپنی قسموں کو تھوڑی قیمت پر بیچ ڈالتے ہیں، ان کے لیے آخرت میں کوئی حصہ نہیں، اللہ تعالیٰ نہ تو ان سے بات چیت کرے گا اور نہ ان کی طرف قیامت کے دن دیکھے گا، نہ انہیں پاک کرے گا اور ان کے لیے دردناک عذاب ہے“۔ (آل عمران ۔ ۷۷)
اور اگر انسان کوئی قسم کھالیتا ہے تو اسے پورا کرنا بھی اس پر فرض ہے:

اللہ تعالیٰ ہم سب کو بلا ضرورت شرعی قسم کھانے سے محفوظ فرمائے، اور اگر کسی اشد ضرورت سے کوئی قسم کھائی جائے تو اس قسم کو پورا بھی کیا جائے، اور سب سے بڑھ کر جھوٹی قسم کھانے سے محفوظ رکھے (آمین)۔
English translation
It is narrated from 'Abdullah ibn 'Umar (may Allah be pleased with him) that he saw 'Umar (may Allah be pleased with him) sitting on his mount, swearing an oath by his father. The Messenger of Allah ﷺ called out to him: “(Beware!) Allah forbids you from swearing by your fathers. So whoever must swear an oath, let him swear by Allah, otherwise let him remain silent.” (Bukhari and Muslim)
Oaths of this kind were common in the age of ignorance (Jahiliyyah). Today, because of distance from and unfamiliarity with the religion, people swear all sorts of oaths — “by my father,” “by my mother,” “by your head,” “by your life” are in common use. In this noble hadith the pure Prophet ﷺ taught the Ummah that if one must swear an oath, one should swear only by Allah, otherwise remain silent. The point is that whatever a person swears by is in reality something he holds in honour and greatness in his heart; and clearly there is none greater and more worthy of honour than Allah, the Lord of Glory — so one should swear only by Him. It must be clarified here that when a person swears by Allah, he in a sense makes Him his witness and guarantor. So before swearing, a person should consider whether, in the matter over which he is making Allah his witness, he is in the right or in the wrong — lest for some fleeting gain he tell a lie in Allah's name and invite the affliction of this world and the Hereafter. For those who swear false oaths there is a most severe warning in the Qur'an; Allah has said:
“Indeed, those who sell Allah's covenant and their own oaths for a small price will have no share in the Hereafter; Allah will neither speak to them nor look at them on the Day of Resurrection, nor will He purify them, and for them is a painful punishment.” (Aal-e-Imran — 77)
And if a person does swear an oath, it is also obligatory upon him to fulfil it:
“And fulfil the covenant of Allah when you have pledged it, and do not break your oaths after their confirmation, when you have made Allah your surety; indeed Allah knows all that you do.” (An-Nahl — 91)
May Allah protect us all from swearing legal oaths without need; and if some dire need requires an oath, may that oath be fulfilled; and above all, may He protect us from swearing false oaths. (Ameen)
