حج کی شرائط
حضرت ابن عمر رضی اللہ تعالیٰ عنہ سے روایت ہے کہ ایک شخص رسول اللہ صلی اللہ علیہ وسلم کی خدمت میں حاضر ہوا اور عرض کیا کہ: “یا رسول اللہ صلی اللہ علیہ وسلم! کون سی چیز حج کو واجب کرتی ہے؟” آپ صلی اللہ علیہ وسلم نے ارشاد فرمایا: “زادِ راہ اور سواری”۔ (ترمذی و ابن ماجہ)
حج اسلام کے بنیادی ارکان میں سے ایک رکن ہے، کتاب و سنت سے اس کی فرضیت ثابت ہے اور امت کا اس کی فرضیت پر اجماع ہے۔ حج کی فرضیت کا قرآن مجید میں اس طرح ذکر آیا ہے: “لوگوں پر اللہ کا یہ حق ہے کہ جو اس گھر تک پہنچنے کی استطاعت رکھتا ہو وہ اس کا حج ادا کرے، اور جو کوئی کفر کی راہ اختیار کرے (یعنی اس حکم کی پیروی سے انکار کرے) تو اسے معلوم ہونا چاہیے کہ اللہ تمام دنیا والوں سے بے نیاز ہے”۔ (اٰل عمران ۔ ۹۷)
اس حدیث میں صحابی کا سوال کون سی چیز حج کو واجب کرتی ہے؟ کا مطلب یہ ہے کہ حج واجب ہونے کی کیا شرائط ہیں؟ چنانچہ آپ صلی اللہ علیہ وسلم نے ایک چیز تو زادِ راہ بتایا ہے جس سے مراد یہ ہے کہ اتنا مال جو سفرِ حج میں جانے اور آنے کے اخراجات اور واپسی اہل و عیال کی ضروریات کے لیے کافی ہو اور دوسری چیز سواری بتائی جس پر سوار ہو کر بیت اللہ تک پہنچا جا سکے۔ اگرچہ حج کے واجب ہونے کی شرطیں اور بھی ہیں، مگر یہاں بطورِ خاص ان ہی دو چیزوں کا ذکر اس لیے کیا گیا ہے کہ اصل میں یہی دو شرطیں ایسی ہیں جو حج کے لیے بنیادی اور ضروری اسباب کا درجہ رکھتے ہیں۔
قرآن مجید کے اوپر گذری ہوئی آیت پر غور کرنے سے معلوم ہوتا ہے کہ “استطاعت رکھ سکتے ہوں” کا مطلب انتہائی وسیع ہے، فقہاء کے نزدیک اس میں مندرجہ ذیل باتیں شامل ہیں: (۱) صحت و تندرست ہونا، بیمار، اندھے، لنگڑے، اپاہج پر حج فرض نہیں، (ب) قادر ہونا، یعنی اس قدر مال ہونا کہ اخراجاتِ سفر مثلاً سواری، رہائش اور خوراک موجود ہو، دوسروں کا دستِ نگر نہ بنے، (ج) اہل و عیال میں جن لوگوں کا نفقہ اس کے ذمہ واجب ہے ان کے ضروری اخراجات کے لیے اتنا مال ہو جو اس کے واپس آنے تک ان لوگوں کے لیے کافی ہو، (د) راستے میں امن ہونا، یعنی راستہ محفوظ ہو، جان و مال کا خوف نہ ہو، مثلاً جنگ، فسادات، سفر کے دوران لوٹ مار وغیرہ، اور (ہ) کوئی ایسی رکاوٹ نہ ہو جیسے قید، جیل یا ظالم حکمران کی سختی۔
مندرجہ بالا پانچ شرائط کے ساتھ عورت پر حج کی فرضیت کے لیے ایک اور شرط یہ ہے کہ عورت کے ساتھ اس کا محرم ہو، کسی مسلمان عورت کے لیے جائز نہیں کہ وہ محرم کے بغیر حج کے لیے جائے۔ محرم ہونے کی شرط کے حوالے سے مندرجہ ذیل باتوں کو مدِ نظر رکھنا ضروری ہے۔ (۱) عورت کا محرم اس کا شوہر ہے یا ہر وہ شخص ہے جس کے ساتھ اس عورت کا نکاح ہمیشہ کے لیے حرام ہو۔ (ب) سفرِ حج میں عورت کے محرم کے لیے ضروری ہے کہ وہ عاقل اور بالغ ہو، نابالغ بچے حج میں محرم کی شرط کو پورا نہیں کرتے، اور بالغ ہونے کا اعتبار کم از کم پندرہ (۱۵) سال کی عمر ہے اور اس بات کا بھی لحاظ رکھا جائے کہ اس کے اندر سوجھ بوجھ بھی پائی جاتی ہو۔ نیز عورت کے لیے ایک شرط یہ بھی ہے کہ وہ عدت کے ایام میں نہ ہو۔
یہ آیت ہر صاحبِ استطاعت کے لیے وجوب کی دلیل ہے، قرآن کی اس آیت کا اختتام اللہ تعالیٰ کی جانب سے ایک سنگین دھمکی سے ہو رہا ہے، یعنی اگر تم استطاعت رکھنے کے باوجود حج نہ کرو گے تو اللہ تعالیٰ کا کیا بگڑے گا وہ تو سارے جہان والوں سے بے نیاز ہے، البتہ سارے کا سارا نقصان تمہارا ہی ہوگا۔
کیونکہ حج اسلام کے پانچ بنیادی ارکان میں سے ایک رکن ہے اور ہر ذی استطاعت مسلمان پر زندگی میں ایک دفعہ فرض ہے اور قرآن و حدیث سے معلوم ہوتا ہے کہ اس کے ادا کرنے میں کوتاہی کرنا سنگین جرم ہے اور استطاعت کے باوجود حج نہ کرنے والے کا ایمان خطرے میں ہے، اللہ تعالیٰ سب مسلمانوں کو حج کی استطاعت اور توفیق عطا فرمائے۔ آمین!

English translation
Ibn Umar (may Allah be pleased with him) reported that a man came to the Messenger of Allah (صلى الله عليه وسلم) and asked: “O Messenger of Allah (صلى الله عليه وسلم)! What makes Hajj obligatory?” The Prophet (صلى الله عليه وسلم) replied: “Provisions for the journey and a mount.” (Tirmidhi and Ibn Majah)
Hajj is one of the fundamental pillars of Islam; its obligation is established from the Book and the Sunnah, and the community is in consensus over its obligation. The obligation of Hajj is mentioned in the Holy Qur’an in these words: “It is a right of Allah upon the people that whoever is able to make his way to the House should perform its Hajj; and whoever disbelieves (that is, refuses to follow this command), then let him know that Allah is free of all need of all the worlds.” (Aal-e-Imran 97)
In this hadith, the Companion’s question, “What makes Hajj obligatory?”, means: what are the conditions for Hajj becoming obligatory? So the Prophet (صلى الله عليه وسلم) mentioned one thing, provisions for the journey—by which is meant enough wealth to suffice for the expenses of going on the journey of Hajj and returning, and for the needs of one’s dependants—and the second thing, a mount, upon which one may ride and reach the House of Allah. Although there are other conditions too for Hajj becoming obligatory, these two are mentioned here in particular because in reality these two conditions are the ones that hold the rank of the fundamental and essential means for Hajj.
Reflecting on the Qur’anic verse mentioned above, it becomes clear that “being able” has a very broad meaning. According to the jurists, it includes the following: (1) being sound and healthy—Hajj is not obligatory upon the sick, the blind, the lame, or the crippled; (b) being financially capable—that is, having enough wealth so that the expenses of the journey, such as the mount, lodging and food, are available, and one does not become dependent on others; (c) having enough wealth for the necessary expenses of those dependants whose maintenance is one’s responsibility, sufficient for them until one’s return; (d) safety on the route—that is, the road being secure, with no fear for life and property, such as from war, disorder, or robbery during the journey; and (e) there being no obstacle such as imprisonment, jail, or the oppression of a tyrannical ruler.
Along with the above five conditions, there is one further condition for the obligation of Hajj upon a woman: that a mahram be with her. It is not permissible for a Muslim woman to go for Hajj without a mahram. Regarding the condition of there being a mahram, the following points must be kept in mind: (1) A woman’s mahram is her husband or any man with whom marriage to that woman is forever forbidden. (b) On the journey of Hajj it is necessary that the woman’s mahram be sane and of age; immature children do not fulfil the condition of a mahram in Hajj, and the criterion for being of age is a minimum of fifteen (15) years, and it should also be considered that discernment be found in him. Moreover, there is also a condition for the woman: that she not be in the days of her waiting-period (iddah).
This verse is a proof of the obligation upon every person who is able. The conclusion of this verse of the Qur’an comes with a stern warning from Allah Almighty: that is, if you do not perform Hajj despite being able, what harm will it do to Allah Almighty? He is free of all need of all the worlds; rather, the whole loss will be yours alone.
Because Hajj is one of the five fundamental pillars of Islam and is obligatory once in a lifetime upon every capable Muslim, and it is known from the Qur’an and Hadith that any negligence in performing it is a grave sin, and the faith of one who does not perform Hajj despite being able is in danger. May Allah Almighty grant all Muslims the capability and the ability to perform Hajj. Amin!
