نکاح کا معیار

حضرت ابو ہریرہ رضی اللہ تعالیٰ عنہ سے روایت ہے کہ رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: ’’اگر تمہاری (لڑکی یا لڑکے) کے بارے میں کوئی رشتہ مل جائے کہ جس کی دینداری اور اخلاق پر تم راضی اور مطمئن ہو تو بلا تاخیر اس سے اپنی اولاد کا نکاح کر دو، اگر تم نے ایسا نہ کیا تو زمین کے اندر بڑا فتنہ اور بہت فساد برپا ہوگا‘‘۔ (ترمذی)
نکاح انسانی زندگی کی ایسی ضرورت ہے جیسے ہوا، پانی وغیرہ۔ اسلام نکاح کے سلسلے میں لمبے چوڑے انتظامات کو کوئی اہمیت نہیں دیتا۔ شریعت اسلامی میں نکاح اس قدر آسان ہے کہ دو شرعی گواہوں کی موجودگی میں ایک مرد اور ایک عورت کا ایک دوسرے کو قبول کر لینا نکاح کو قائم کر دیتا ہے۔ اس لیے کہ جس معاشرے میں نکاح عام ہوگا وہاں زنا مشکل، اور جہاں معاملہ اس کے برعکس ہوگا تو پھر اس معاشرے میں زنا اور غلط تعلقات عام ہوں گے۔
اس حدیث میں رسول اللہ صلی اللہ علیہ وسلم نے لڑکی یا لڑکے کے نکاح کا معیار دین دار اور با اخلاق ہونا قرار فرمایا ہے اور ہدایت فرمائی ہے کہ اگر ایسا رشتہ مل جائے تو نکاح کر دو۔ پھر فرمایا اگر ایسا نہیں کیا گیا بلکہ دین کے بجائے حسن صورت، مال و دولت یا اونچے خاندان کو دیکھا اور نکاح میں دیر کی تو اس کے نتیجے میں فتنہ و فساد پیدا ہوگا۔ لڑکے اور لڑکیاں گناہ آلود زندگی گزارنے پر مجبور ہوں گے جس سے والدین اور خاندان معاشرے میں بدنام اور ذلیل ہوں گے، زنا کی کثرت ہوگی اور ان سب کا وبال ان والدین یا سرپرستوں پر پڑے گا جو اس کے ذمہ دار ہیں۔
حضرت حسن بصریؒ سے ایک شخص نے دریافت کیا، حضرت میری لڑکی شادی کے قابل ہے، اس کے لیے بہت سے لوگ رشتے کے خواہشمند ہیں، اب لڑکے کے انتخاب کے بارے میں آپ کی رائے کیا ہے؟ فرمایا ایسے لڑکے کا انتخاب کرو جس کے دل میں اللہ کا خوف ہو یعنی تقویٰ اور دینداری ہو اور وہ تمہاری لڑکی سے محبت کرے اور اس کی محبت میں تعظیم و احترام کا پہلو بھی ہو کہ کسی وجہ سے ناراض ہو تو ظلم و زیادتی نہ کرے۔ یعنی لڑکا اپنی بیوی سے دین و اخلاق کے لحاظ سے محبت کرنے والا ہو، محبت کا سبب حسن و جمال اور مال نہ ہو، کیونکہ جب دین اور اخلاق کی بنیاد پر محبت کا تعلق قائم ہوگا تو اس کے ساتھ احترام و عظمت بھی ہوگی، اس لیے غلطیوں اور کوتاہیوں پر تنبیہ تو کرے گا ظلم نہ کرے گا کہ اللہ کے سامنے جواب دہی اس کو ایسا کرنے سے روکے گی۔ اور اگر کہیں نکاح اور محبت حسن و مال کی بنا پر ہے تو ان کے جانے سے اس کی محبت میں بھی فرق آئے گا اور جب خوف خدا نہ ہوگا تو پھر ظلم و زیادتی سے اس کو کون سی چیز روکے گی۔
رسول اللہ صلی اللہ علیہ وسلم نے سیدۃ النسا فاطمہ رضی اللہ تعالیٰ عنہا کو سیدنا علی رضی اللہ تعالیٰ عنہ کے نکاح میں دیا تو اس وقت حضرت علیؓ کے پاس علم و تقویٰ کا تھا مگر دنیاوی مال و متاع سے وہ فارغ تھے، یہاں تک کہ رہائش کے لیے مکان تک نہ تھا اور مال میں فقط ایک زرہ تھی جس کو بیچ کر حق مہر ادا کیا۔ لیکن وہ مسائل جو آج کل ہمارے گھروں میں عام ہیں ان میاں بیوی میں ان کا نام و نشان بھی نہیں تھا۔
ایسا نہیں کہ شریعت اس بات سے روکتی ہے کہ بیٹی کا رشتہ کرنے سے پہلے لڑکے کے مالی حالات کو بالکل پیش نظر نہ رکھا جائے۔ مقصد یہ ہے کہ اگر لڑکے کے پاس اتنے وسائل ہوں کہ اپنی بیوی کے نان نفقے کا بار اٹھا سکتا ہو تو پھر اس بات کو نہیں دیکھنا چاہیے کہ اس کے پاس گاڑی، بنگلہ اور بینک بیلنس کتنا ہے۔
جب شادی کا بنیادی معیار تقویٰ اور نیکی ہوگا تب یہ جوہر اور وصف ان کی اولاد میں بھی آئے گا اور اس سے ایک ایسے معاشرے کی بنیاد پڑتی ہے جس کا معیار عزت اور شرف صرف نیکی اور صلاح ہوگا نہ کہ مال و دولت۔ فاعتبروا یا اولی الالباب!
English translation
Hazrat Abu Hurayrah (may Allah be pleased with him) narrated that the Messenger of Allah (peace be upon him) said: “If a marriage proposal comes to you concerning your (daughter or son), of one with whose religiousness and character you are pleased and satisfied, then marry your child to them without delay; if you do not do so, there will arise great trial (fitnah) and much corruption (fasad) in the land.” (Tirmidhi)

Marriage is a need of human life like air, water and the like. Islam attaches no importance to elaborate arrangements in the matter of marriage. In the Islamic Shariah marriage is so easy that, in the presence of two lawful witnesses, a man and a woman accepting one another establishes the marriage. This is because in a society where marriage is common, adultery is difficult, whereas where the matter is the reverse, adultery and illicit relations become common in that society.
In this hadith the Messenger of Allah (peace be upon him) laid down that the standard for the marriage of a girl or boy is religiousness and good character, and he directed that if such a match is found, then perform the marriage. He then said that if this is not done, but instead of religion one looks at beauty of appearance, wealth and riches, or a high family, and delays the marriage, then trial and corruption will result. Boys and girls will be compelled to lead sin-stained lives, through which the parents and family will be disgraced and humiliated in society, adultery will increase, and the burden of all this will fall upon those parents or guardians who are responsible for it.
A man asked Hazrat Hasan al-Basri (may Allah have mercy on him): Sir, my daughter is of marriageable age, and many people desire a match for her; now what is your opinion regarding the choice of a boy? He said: choose such a boy in whose heart there is the fear of Allah — that is, taqwa and religiousness — and who will love your daughter, and in whose love there is also the aspect of honour and respect, so that if he becomes displeased for some reason he will not commit injustice and excess. That is, the boy should love his wife on the basis of religion and character; the cause of the love should not be beauty and wealth — because when the bond of love is established on the basis of religion and character, then with it there will also be respect and esteem, and so he will admonish over mistakes and shortcomings but will not commit injustice, for accountability before Allah will restrain him from doing so. And if somewhere the marriage and love are based on beauty and wealth, then when these depart, his love too will change, and when there is no fear of God, what will then restrain him from injustice and excess?
The Messenger of Allah (peace be upon him) gave the Chief of Women, Fatimah (may Allah be pleased with her), in marriage to Sayyiduna Ali (may Allah be pleased with him). At that time Hazrat Ali (may Allah be pleased with him) possessed knowledge and taqwa, but he was devoid of worldly goods and possessions — so much so that he did not even have a house to live in, and in the way of wealth he had only a coat of armour, which he sold to pay the dower. But the problems that are common today in our homes had no trace whatsoever between that husband and wife.
It is not that the Shariah forbids that, before arranging a daughter’s match, the boy’s financial circumstances be kept in view at all. The point is that if the boy has enough means to bear the burden of his wife’s maintenance, then one should not look at how much of a car, bungalow and bank balance he has.
When the fundamental standard of marriage is taqwa and righteousness, then this essence and quality will come into their offspring as well, and from this is laid the foundation of a society whose standard of honour and nobility is only righteousness and goodness, not wealth and riches. So take heed, O people of understanding!
